Our thirty-two year old client suffered a stroke after undergoing chiropractic manipulation of her neck. She presented to her HMO exhibiting symptoms of her stroke but the health care providers at the HMO failed to recognize her symptoms and failed to initiate treatment that would have reversed the effects of the stroke. As a result, our client suffered "locked-in syndrome" in which she was unable to move any parts of her body except her eyes. Although the issues of negligence and causation were hotly contested, a settlement was reached after mediation. This settlement occurred in the District of Columbia, where there was no cap that limited the amount of damages a patient could recover.
