When You Have Been Injured,Your Attorney's Experience Matters

Addressing the aftermath of a crash with an Amazon driver

With the rise of online shopping, Amazon delivery vehicles have become a very common sight on roads across the country. While these deliveries are convenient for consumers, they also contribute to an increase in traffic and, unfortunately, accidents. It is now well known that the Amazon delivery driver program is not particularly safe, to say nothing of the fact that driving on U.S. roads is not a terribly safe endeavor to begin with.

Partially because Amazon is a massive company, when a crash involves an Amazon driver, the aftermath can be especially complicated. If you or a loved one has been injured in this kind of crash, know that understanding your rights and how to navigate the claims process successfully could make a big difference when it comes to achieving the end goal of receiving the maximum amount of compensation to which you are entitled.

Liability concerns and seeking fair compensation

One of the most important questions you’ll need to consider is who may be held liable. Amazon uses a combination of its own delivery service (Amazon Flex) and third-party delivery service providers (DSPs). Amazon Flex drivers are considered independent contractors and often use their personal vehicles to make deliveries. DSP drivers are employed by companies contracted by Amazon. In both cases, Amazon has structured its business model in a way that often distances the company from direct legal responsibility, but that does not mean you are without options.

If the Amazon driver was at fault, the first step is determining the driver’s employment status and whether they were actively working at the time of the crash. This is important because it affects what insurance coverage applies. Amazon provides commercial auto insurance for drivers who are actively delivering packages through its Flex program. For drivers employed by a DSP, the delivery service is required to carry commercial insurance. However, if the driver was off-duty or using their vehicle for personal errands, their personal auto insurance may be the only coverage available.

Given the legal complexity of these cases, speaking with a personal injury attorney right away is highly recommended. Do not speak with anyone from the company or any insurers until you’ve retained the assistance of a legal professional who is duty-bound to act in service of your interests.

Crashes involving Amazon delivery drivers are not always straightforward. Legal guidance can make all the difference in holding the right parties accountable and securing the compensation you deserve. The stress of this situation is undeniable, but you don’t have to weather it alone.
